Terms of Service

Wayfolio is operated by Patchy Home Services Inc. (“Patchy Home Services”, “we”, “us”, or “our”), a company incorporated in Canada. Wayfolio is our mobile application and website for saving, organizing, mapping, and sharing places.

You can reach us at any time at info@patchy.ca.

By downloading, installing, or using the Wayfolio app, visiting the Wayfolio website, joining the waitlist, or creating a Wayfolio account, you enter into a binding agreement with Patchy Home Services Inc. and agree to these Terms of Service.

If you do not agree to these terms, do not use Wayfolio. These terms apply together with our Privacy Policy, which explains how we handle your information.

You must be at least 13 years old to use Wayfolio. If you are under the age of majority where you live, you may use Wayfolio only with the involvement of a parent or legal guardian who agrees to these terms.

By using Wayfolio you confirm that you meet these requirements and that you are not barred from using the service under applicable law.

Wayfolio lets you save places such as restaurants, cafes, hidden spots, and travel ideas, add them from links, notes, screenshots, or search, organize them on a map, and share lists with other people.

Some features, including AI-assisted place search and import from links, notes, or screenshots, are provided on a best-effort basis. We may change, add, or remove features as the product develops.

Some features require an account. You can sign in with Apple or Google. You are responsible for keeping access to your account secure and for activity that happens under your account.

You agree to provide accurate information and to notify us at info@patchy.ca if you believe your account has been accessed without your permission.

Wayfolio is free to use with usage limits on some features. Wayfolio Plus is an optional auto-renewable subscription that raises or removes those limits. The exact subscription name, duration, included features, and price are shown in the app before you confirm a purchase, in your local currency.

The following terms apply to subscriptions purchased through the Apple App Store:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the price then in effect for your subscription.
• You can manage your subscription and turn off auto-renew in your Apple ID Account Settings after purchase.
• Cancelling stops future renewals; the current paid period continues until it expires and is not cancelled retroactively.
• If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription covering the same period.
• Refunds are handled by Apple under the App Store terms. We do not control App Store refunds, but you can contact us at info@patchy.ca and we will help where we can.

We may change subscription prices or the features included in a plan. Price changes do not apply to the period you have already paid for. Where required, Apple or we will notify you in advance and ask for your consent before a renewal at a new price.

If you do not accept a change, you can turn off auto-renew before the next renewal date.

These terms are between you and Patchy Home Services Inc. only, and not with Apple Inc. Patchy Home Services Inc., not Apple, is solely responsible for Wayfolio and its content.

Your use of Wayfolio must comply with the Apple Media Services Terms and Conditions, including the Usage Rules for licensed applications. Apple has no obligation to provide maintenance or support for Wayfolio.

If Wayfolio fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Wayfolio, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.

Patchy Home Services Inc., not Apple, is responsible for addressing any claims relating to Wayfolio, including product liability claims, claims that Wayfolio fails to conform to legal or regulatory requirements, claims arising under consumer protection or similar legislation, and third-party claims that Wayfolio infringes intellectual property rights.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce these terms against you as a third-party beneficiary.

You may add places, lists, notes, links, photos, comments, and other content to Wayfolio. You keep ownership of the content you submit.

You grant Patchy Home Services Inc. a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, and display your content solely as needed to operate, secure, and improve Wayfolio, including sharing content with people you invite to a list.

You are responsible for the content you add. Do not upload content you do not have the right to share, and remember that anything you add to a shared or public list can be seen and copied by other members of that list.

Wayfolio uses third-party AI services to suggest places and to extract place details from links, notes, and screenshots you provide. Content you submit to these features is sent to those providers for processing.

AI output can be incomplete or wrong. Treat suggested places, addresses, hours, and descriptions as starting points and verify important details before you rely on them.

You agree not to misuse Wayfolio or interfere with other users, third-party services, or the operation of the product.

• Do not use the service for unlawful, harmful, abusive, deceptive, harassing, or infringing activity.
• Do not attempt to access systems, accounts, or data without permission.
• Do not scrape, overload, reverse engineer, or disrupt the service except where allowed by law.
• Do not upload content that violates the rights, privacy, or safety of another person.
• Do not use Wayfolio to track, stalk, or reveal the location of another person without their consent.

Wayfolio relies on third-party services for maps, place data, authentication, hosting, analytics, subscriptions, and email. Place details, photos, ratings, and map results may come from those providers.

Third-party services have their own terms and privacy practices. We are not responsible for services we do not control.

You can stop using Wayfolio at any time. You can request deletion of your account and associated data by writing to info@patchy.ca, and we will action the request within a reasonable time.

Deleting your account does not automatically cancel a subscription purchased through the App Store. Turn off auto-renew in your Apple ID Account Settings.

We may suspend or terminate access if you breach these terms, if your use creates risk or legal exposure for us or other users, or if we are required to do so by law.

Wayfolio is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that any place, rating, opening hours, address, map result, or third-party detail is accurate, complete, current, or available. You are responsible for checking opening hours, safety, accessibility, pricing, and other important details before visiting a place.

To the fullest extent permitted by law, Patchy Home Services Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of Wayfolio.

To the fullest extent permitted by law, our total liability for all claims relating to Wayfolio is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $50.

Some jurisdictions do not allow certain limitations or exclusions, so parts of this section may not apply to you. Nothing in these terms limits rights you have under mandatory consumer protection law.

You agree to indemnify and hold harmless Patchy Home Services Inc. and its directors, officers, and employees from claims, damages, and costs arising out of your content, your use of Wayfolio, or your breach of these terms, except to the extent caused by us.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules.

The courts of Ontario, Canada have exclusive jurisdiction over disputes relating to these terms, except where mandatory law in your country of residence gives you the right to bring a claim elsewhere.

We may update these terms as Wayfolio changes. When we make material changes, we will update the date above or provide another reasonable notice.

Your continued use of Wayfolio after changes take effect means you accept the updated terms.
